Arbitration is very similar to court proceedings, and arbitrators hear the dispute in a manner that can be compared to a trial. It is mainly regulated by the Arbitration Act, 1965.<\/p>\n<p>Mediation is a more informal procedure whereby the dispute is settled with the assistance of a neutral third party and only resolved when all parties agree. An inter vivos trust is created during the founder&#8217;s lifetime by a trust instrument.<\/p>\n<p>Trustees thus have a fiduciary duty to manage the trust to the benefit of the beneficiaries of the trust.
